|Labor Commissioner Clarifies State's Position|
Statement from the DLSE
"The Labor Commissioner has maintained, as the agency authorized to interpret and enforce section 450, that where certain factors exist, there are presumptive violations of the law. In a letter dated May 24, 2002, the Labor Commissioner took the position that single session workshops that actors pay a fee to attend, submit head shots and resumes, and perform readings for a casting director or his assistant representing a producer with current casting needs for film or television will be presumed to be in violation of the law. The Labor Commissioner also takes the position that workshops where performance time substantially outweighs teaching time are likewise presumed to be in violation of the law."
